This English version is provided for information purposes only. In the event of any discrepancy, the German version prevails.
1. Scope
These Terms and Conditions apply to all treatments, services and appointments arranged between Therakura S.à r.l. and its patients or clients. These Terms and Conditions are deemed accepted when an appointment is booked, or at the latest when a treatment is received.
2. Booking appointments
Appointments can be made by telephone, by email, via WhatsApp or online — therapy appointments via Doctena, Pilates classes via Eversports. Booked appointments are binding.
3. Cancellations and missed-appointment fee
Appointments must be cancelled or rescheduled at least 24 hours in advance. If an appointment is cancelled less than 24 hours in advance without good reason, or in the event of non-attendance, we charge a missed-appointment fee: for CNS treatments, in accordance with the item provided in the CNS nomenclature for appointments that were not cancelled (ZCP1); for all other services, in the amount of the price of the scheduled treatment. The health insurance fund (CNS) does not cover any costs for missed appointments. If Therakura waives the missed-appointment fee in an individual case, this is done as a gesture of goodwill and does not give rise to any entitlement in future cases.
4. Treatments
All treatments are carried out on the basis of the therapy discussed between the therapist and the patient. The success of treatment cannot be guaranteed. The patient undertakes to inform the therapist of any existing illnesses, symptoms, pregnancies, medications or other health restrictions.
5. Prices and payment
Payment is made either directly after the treatment, by invoice or via CNS billing (where applicable). Private services or services not covered by the CNS must be paid for by the patient. Invoices are payable within 14 days. In the event of late payment, we reserve the right to charge reminder fees.
6. CNS / health insurance billing
For treatments covered by the CNS, the current CNS rates and statutory provisions apply. However, the patient remains, in principle, liable for payment of the treatment costs, even if the health insurance fund provides reimbursement.
7. Gift vouchers
Gift vouchers are transferable and valid for 2 years from the date of issue, unless otherwise stated. They cannot be redeemed for cash.
8. Liability
To the extent permitted by law, the liability of Therakura S.à r.l. is limited to intent and gross negligence. This limitation does not apply to damage resulting from injury to life, body or health or to cases in which the law mandatorily provides for further liability. No liability is accepted for personal belongings brought along, except in cases of intent or gross negligence.
9. Data protection
Personal data are treated confidentially and processed exclusively within the framework of the statutory data protection provisions (General Data Protection Regulation, GDPR). Further information can be found in the Privacy Policy on the website.
10. Pilates classes and class passes
The following additional rules apply to group classes (e.g. mat Pilates). Bookings are made via our booking partner Eversports (Eversport GmbH, Vienna), for which a free customer account is required. Eversports’ terms of use also apply to the use of the Eversports platform.
Class sessions are booked individually and paid for with a single ticket, a class pass or an intro offer. Class passes are personal and non-transferable; they are valid from the date of purchase for the period stated in each case (single ticket two months, 3-class intro six weeks, 10-class pass six months). Unused sessions expire at the end of the validity period; a cash refund is not possible. In the event of longer-term inability to train confirmed by a doctor, the validity of the 10-class pass can be extended by the corresponding period on request. The same applies if booked sessions are cancelled by Therakura and no suitable replacement session can be offered within the validity period. The 3-class intro can only be purchased once and only by new customers.
A booked session can be cancelled free of charge up to 24 hours before it starts; the session is then credited back to the pass or ticket. In the event of later cancellation or non-attendance, the session is forfeited. If a session is fully booked, a waiting list can be used; if a place becomes available, everyone on the waiting list is notified and the place goes to the first booking received.
Therakura may cancel individual sessions if the instructor is ill or for organisational reasons. Cancellations due to insufficient participant numbers are made no later than 24 hours before the start; during the start-up phase of the class programme, all sessions take place regardless of the number of participants. If Therakura cancels a session, sessions already booked are credited back in full. Participation is at your own responsibility; if you have existing medical conditions, are pregnant or have acute symptoms, please seek medical advice before taking part and inform the instructor.
No VAT is currently charged on class products (small business exemption under Art. 57 of the Luxembourg VAT Act); the prices stated are final prices. Invoices are issued via Eversports.
10a. Right of withdrawal for online purchases
If you, as a consumer, buy a single ticket, a class pass or an intro offer online (via Eversports), your contract is with Therakura S.à r.l. The following applies to these online purchases:
Right of withdrawal. You can withdraw from your purchase within 14 days of the day the contract was concluded, without giving any reason.
How to withdraw. Inform us of your withdrawal by means of a clear statement, most easily by email to info@therakura.lu (or by post to Therakura S.à r.l., 4, Rue de Canach, L-5368 Schuttrange). Please state your name, the product purchased and the date of purchase. To meet the deadline, it is sufficient to send your statement before the 14 days have expired. You can use the model form below, but you do not have to.
Units already used. You can still withdraw if you have already used units. Units consumed (attendance at a booked unit, or forfeiture of a unit under the rules in section 10) are charged at the regular single price (the price of a single ticket, currently €26) and deducted from the amount paid; we refund the remainder. If the value of the units consumed reaches the amount paid, no refund is due. If you book a unit within the withdrawal period, you thereby expressly request that we begin the service before the period ends.
Effects of withdrawal. We will refund the purchase price (less any units already consumed) without undue delay and no later than 14 days after receiving your withdrawal, using the same means of payment you used for the purchase; we will not charge you any fees for this. On withdrawal, the ticket or pass becomes invalid and any units already booked are cancelled.
There is no right of withdrawal for purchases made in person at the practice.

The place of jurisdiction is Luxembourg, to the extent permitted by law; mandatory places of jurisdiction for consumers remain unaffected.
